GENERAL TERMS AND CONDITIONS (GTC) of the private pension

1. SCOPE
1.1 These terms and conditions apply to contracts for the leasing of guest rooms for temporary accommodation, as well as all other services of the guesthouse "Praxmarer" provided to the guest. They can be replaced by conditions negotiated on a case-by-case basis. These terms and conditions are visible to every guest in the guesthouse or on the website of the pension.
1.2. The subletting or re-letting of the rooms provided as well as their use for purposes other than accommodation require the prior written consent of the Pension.
1.3. Terms and conditions of the guest apply only if previously agreed.
2. CONCLUSION OF CONTRACT
2.1. The accommodation contract is concluded when the provision of a room has been reserved by the guest by telephone, e-mail or Internet and has been confirmed by us. Confirmation by the Pension "Praxmarer" can also be made by phone, e-mail or, on request, by letter. An accommodation contract has also been concluded by conclusive behavior, especially if a room is ordered and provided and for reasons of time an explicit commitment is not possible.
2.2. Contractual partners are the pension "Praxmarer", represented by Mrs. Praxmarer, and the guest. If an orderer acts on behalf of or for guests registered by him, he shall be liable for the liabilities thereby established and all obligations arising from the contract for the taking up of a contract.
3. SERVICES, PRICES AND PAYMENT
3.1. The pension "Praxmarer". is obliged to keep the rooms booked by the guest or customer available and to render the agreed services. Reservations of parking spaces for bicycles and motorcycles in the yard are only available to the guest
in case of prior approval by the pension and only limited over the agreed time.
3.2. The total amount of the bill is payable in cash on the day of arrival. Checks, credit cards or debit cards can not be accepted. In case of an earlier departure (for whatever reason) the entire amount remains due.
3.3 Accounting is only possible for permanent guests and regulars. Invoices of the Pension "Praxmarer" without a due date are payable without deduction within one week after the invoice date. In the event of late payment, the Pension is entitled to charge interest at the rate of 5% above the respective key interest rate (main refinancing rate) of the European Central Bank.
3.4. The agreed prices include the respective statutory value added tax. If the period between conclusion of the contract and performance of the contract exceeds 4 months and the price charged by Praxmarer for such services generally increases, the latter may raise the contractually agreed price appropriately, but not by more than 10%.
3.5. Prices may also be changed by the Pension "Praxmarer" if the client wishes to change the number of booked rooms, the pension or the stay of the guests and the pension agrees.
3.6. Pension "Praxmarer" is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or afterwards. The amount of the advance payment and the payment dates are agreed in writing. When booking a room we ask for a deposit of 25%.
4. CANCELLATION OF THE CUSTOMER (cancellation, cancellation)
4.1. A resignation of the guest from the contract concluded with the board "Praxmarer" requires the written consent of the pension. If this is not done, then the agreed price from the contract is payable even if the guest does not use contractual services. This does not apply in cases of delayed performance of the pension or any impossibility of providing services for which it is responsible.
4.2. If between the pension "Praxmarer". and the guest has an appointment to withdraw from the contract was agreed in writing, the guest can until then withdraw from the contract, without triggering payment or damage claims of the pension. The right of withdrawal of the guest expires if he does not exercise his right to resign in writing to the pension by the agreed date, unless there is a case of default of performance of the pension or an impossibility of providing services for which it is responsible.
4.3. For rooms not used by the guest, the pension has to take into account the income from other rental of the rooms as well as the saved expenses.
4.4. The guest is free to prove that no damage has occurred or that the damage incurred by the guesthouse is lower than the damage

If you cancel from your side, you will be charged 30% from the first month before your arrival and 90% from one week prior to your arrival.
For no-show:
100% of the total invoice amount.
5. WITHDRAWAL OF THE PENSION
5.1. If a right of withdrawal of the guest within a certain period was agreed in writing, the pension is "Praxmarer". during this period, in turn, entitled to withdraw from the contract, if inquiries from other guests to the contractually booked rooms are available and the customer on consultation of the pension on his right to resign.
5.2. If an agreed advance payment is made even after the expiry of a reasonable grace period set by the pension
The pension is also entitled to withdraw from the contract.
5.3. Furthermore, the pension is entitled to withdraw from the contract for a materially justified reason, for example, if force majeure or other circumstances beyond the control of the guesthouse make fulfillment of the contract impossible; Rooms misleading or misrepresenting material facts, e.g. in the person of the guest or the purpose to be booked; the pension has reasonable cause to believe that the use of the pension benefits may jeopardize the smooth running of the business, the security or the reputation of the pension in public, without this being attributable to the sphere of control or organization of the pension; A violation of the above scope of paragraph 2 is present.
5.4. The pension must notify the customer of the exercise of the right of withdrawal without delay.
5.5. In the case of legitimate resignation of the pension no claim of the customer for compensation for damages arises.
6. ROOM REPRODUCTION, TRANSFER AND RETURN
6.1. The guest acquires, unless otherwise agreed, no claim to the provision of certain rooms.
6.2. Check in: The rooms can be occupied between 12 and 20 o'clock. Other arrival times are to be agreed with the pension.
The pension "Praxmarer". is entitled, in the interest of minimizing damage, to vacate the room from 8 pm onwards and in the following days for further reservations. Arrival and departure are valid for the reservation as a day, so it counts the number of nights.
6.3. Check out: On the agreed departure day, the rooms of the guesthouse must be vacated by 10.00 am at the latest. Thereafter, the guesthouse may charge 50% of the full room price (list price) until 3 pm for the additional use of the room, from 15:00 o'clock 100%. The guest is free to prove to the pension that no or much lower damage has occurred.
7. LIABILITIES
7.1. The guest or contractual partner is liable to the Pension "Praxmarer" for the damage caused by him or his guests
(For example, for damage to the furniture and equipment, loss of keys, possibly key emergency service).
7.2. Pension "Praxmarer" is not liable to the guest or the contracting party if the provision of services is rendered impossible due to force majeure. In these cases, the pension endeavors to procure equivalent services elsewhere.
7.3. It is the guest's responsibility to insure items brought against theft, damage or destruction. A liability of
Pension "Praxmarer" in their loss, theft, damage or destruction is excluded.
7.4. Should faults or deficiencies occur in the services of the guesthouse, the guesthouse will make every effort to remedy the situation, if the customer knows or is promptly notified. The guest, for his part, is obliged to do his utmost to remedy the disturbance and minimize possible damage. The liability claims expire if the customer does not notify immediately after gaining knowledge of loss, destruction or damage to the pension.
7.5. Insofar as the guest makes use of the limited parking space on the property Neu-Peida 30, no custody agreement is concluded. In the event of loss or damage to a car parked or shunted on the property,
Bicycles or motorcycles and their contents are not liable for the pension, except in case of intent or gross negligence.
7.6. Wake-up calls, messages, postal and goods shipments for guests are not part of the service range of the pension "Praxmarer".
If these services are taken over by agreement in exceptional cases, they must be executed with the utmost care. Claims for damages, except for gross negligence or intent, are excluded.
8. FINAL PROVISIONS
8.1. Place of fulfillment and payment as well as place of jurisdiction is the seat of the pension: St. Sigmund in Sellraintal in Tirol.
8.2. Should individual provisions of these General Terms and Conditions for the accommodation contract and accommodation in the guest house be or become invalid or void, this shall not affect the validity of the remaining provisions. In addition, the statutory provisions apply.
